This Data Protection Policy is issued by David Turner Legal Services Ltd in accordance with the General Data Protection Regulations to confirm how we use and process any personal information we collect from our clients during the course of any work undertaken on their behalf.
Under the General Data Protection Regulations, our firm is a “controller” of any personal information that we collect from you.
Our Data Protection Officer is David Turner and most of the data is collected by him personally when you instruct us to provide legal advice and services to you.
What data will we collect?
The personal data collected will be the information that you have provided to us which will usually include names, contact details (postal addresses, telephone numbers and email addresses) and dates of birth for you and other people involved in the matter that we are instructed to deal with on your behalf.
In addition, depending on the type of matter we are instructed to deal with on your behalf, we may also need bank details and National Insurance numbers for yourself and other people.
Special categories
When we are instructed to prepare Wills or Lasting Powers of Attorney on your behalf, we need to ascertain that you have the mental capacity to sign the documents. This collected information is referred to in the General Data Protection Regulations as being in a “special category” as it relates to a person’s mental health.
This will also apply in relation to a third party who is the subject of a deputyship application to the Court of Protection. The collected information on the health of that third party will be processed in order to make the court application once we have received instructions from the proposed deputy.
Processing of your personal information
The personal information that we collect from you enables us to register you as a new client of our firm and effectively carry out the services you wish us to undertake on your behalf. It also fulfils our legal and regulatory obligations as a law firm.
Who will we share your information with?
Any personal information provided by you to our firm is confidential and will only be shared with suppliers and third parties so far as it is necessary to enable us to carry out the work you have instructed us to do on your behalf. Such suppliers and third parties will only be allowed to process your personal information for specified purposes and in accordance with our instructions.
We will not share your personal information with any third party for marketing purposes.
How long do we keep personal information?
Following completion of the legal services you have requested us to carry out on your behalf, we will continue to retain your personal information for a specified minimum period to comply with regulatory requirements to retain such data.
